Terms & Conditions

These Terms & Conditions (“Terms”) govern access to and use of lisascala.com, our online store, and related services offered by Lisa Scala Jewelry (“Lisa Scala Jewelry,” “we,” “us,” or “our”). By using the website, creating an account, or placing an order, you agree to these Terms and the policies incorporated by reference. Last updated: July 22, 2026

2. Eligibility

You must be legally capable of entering a binding agreement in your jurisdiction. If you use the website on behalf of a business or other organization, you represent that you are authorized to bind it.

3. Website Use

You may use the website only for lawful personal or business purposes consistent with these Terms. You may not:

  • Use the website in violation of law or another person’s rights;
  • Attempt unauthorized access to accounts, systems, data, or security features;
  • Introduce malware, harmful code, automated attacks, or excessive traffic;
  • Scrape, harvest, copy, or extract content or data except as allowed by law or written permission;
  • Impersonate another person or submit false information;
  • Use the website to commit fraud or facilitate unlawful activity;
  • Interfere with website operation, checkout, inventory, or pricing; or
  • Use our content, product images, designs, or trademarks to create or market competing or counterfeit products.

4. Accounts

You are responsible for information submitted through your account and for keeping credentials confidential. Notify us promptly of suspected unauthorized use. We may suspend or close an account for security, fraud prevention, policy violations, or legal reasons.

5. Product Information

We strive to describe products accurately. Handmade jewelry and natural materials may vary in color, texture, dimensions, inclusions, pattern, finish, and appearance. Photographs may be enlarged to show detail and may appear different because of lighting and screen settings.

Weights, measurements, carat weights, dimensions, and colors may be approximate unless expressly stated as certified. Natural variations are not ordinarily defects.

6. Product Availability and Inventory Accuracy

Many Lisa Scala Jewelry pieces are handcrafted, one of a kind, or offered for sale simultaneously through our website and our Georgetown gallery. Online inventory is not always synchronized with in-store sales in real time.

An item displayed as available online may have been sold in the gallery before the website inventory updates. If that occurs, we will notify you promptly and may offer an approved comparable replacement, future delivery if available, store credit, or a full refund to the original payment method for the unavailable item.

Inventory is not guaranteed until an order is accepted. We reserve the right to limit quantities, discontinue products, or cancel an order when merchandise is unavailable, contains a pricing or inventory error, or cannot reasonably be fulfilled.

7. Prices and Taxes

Prices are shown in U.S. dollars unless otherwise stated and may change without notice. Applicable taxes, shipping, insurance, customization, sizing, duties, and other charges are added as disclosed.

We may correct typographical, pricing, inventory, or description errors and may cancel or adjust an order affected by an obvious error before fulfillment. If payment was captured, we will refund the canceled amount.

8. Orders and Acceptance

An order confirmation acknowledges receipt but does not necessarily constitute acceptance. We may accept, decline, limit, or cancel an order for reasons including availability, suspected fraud, pricing error, payment failure, shipping restriction, policy violation, or inability to complete customization.

A binding sales agreement is formed when we accept the order by shipping the item, confirming pickup availability, or otherwise expressly accepting it.

9. Payment

You authorize us and our payment providers to charge the selected payment method for the order total and any separately approved charges. You represent that you are authorized to use the payment method and that billing information is accurate.

Payment providers may perform fraud screening, authorization, and identity verification. We do not ordinarily store complete payment-card numbers.

10. Deposits and Payment Plans

Custom work, special orders, layaway arrangements, repairs, or high-value items may require a deposit or scheduled payments. Terms will be disclosed at the time of the arrangement. Deposits may become non-refundable after design, sourcing, fabrication, alteration, or other work begins.

Unless otherwise agreed in writing, ownership and delivery do not transfer until the balance and all approved charges are paid.

11. Custom, Personalized, and Made-to-Order Work

Custom and made-to-order work may require customer approval of sketches, digital renderings, stones, dimensions, metal, text, sizing, price, and timing. Visual renderings are illustrative and may not perfectly represent the finished handmade piece.

The customer is responsible for reviewing spelling, dates, dimensions, and other specifications before approval. Changes requested after approval may require additional charges and extend the timeline.

12. Ring Sizing and Alterations

The customer is responsible for supplying an accurate size. Not every ring can be resized, and some resizing may affect pattern, finish, stone setting, engraving, proportions, or durability. We may decline a requested alteration that could compromise the piece.

13. Repairs

Repair estimates are based on the condition visible at intake. Additional issues may become apparent during disassembly or repair. We will seek approval before materially exceeding an estimate when reasonably possible.

We are not responsible for pre-existing hidden defects, undisclosed prior repairs, unstable stones, or weaknesses inherent in aged or damaged materials, except to the extent caused by our failure to use reasonable care.

14. Shipping and Delivery

Shipping is governed by our Shipping Policy, incorporated into these Terms. Delivery dates are estimates unless expressly guaranteed in writing.

15. Returns and Refunds

Returns, refunds, exchanges, damaged-item claims, and final-sale exclusions are governed by our Return & Refund Policy, incorporated into these Terms.

16. Jewelry Care and Warranty

Care instructions and limited warranty terms are stated in our Jewelry Care & Warranty, incorporated into these Terms.

17. Gift Cards and Store Credit

Gift cards and store credits are not redeemable for cash except where required by law. They may not be replaced if lost, stolen, destroyed, or used without permission unless required by law or we can verify the balance and ownership.

Expiration, dormancy, and redemption are governed by applicable law and any terms disclosed at issuance.

18. Promotions

Promotions are subject to stated eligibility, dates, exclusions, and limits. Unless expressly allowed, offers cannot be combined, applied retroactively, exchanged for cash, or used for gift cards, custom work, repairs, taxes, or shipping.

We may cancel or modify a promotion affected by error, abuse, fraud, or circumstances beyond our control.

19. Wholesale Purchases

Wholesale purchases may be subject to separate application, minimum-order, resale-certificate, territory, pricing, payment, intellectual-property, and return terms. When separate wholesale terms conflict with these Terms, the wholesale terms control for the wholesale transaction.

20. Intellectual Property

The website and its content—including jewelry designs, photographs, text, graphics, logos, trademarks, videos, layouts, and software—are owned by or licensed to Lisa Scala Jewelry and protected by intellectual-property laws.

No purchase transfers intellectual-property rights in a design. You may not reproduce, manufacture, copy, adapt, distribute, publish, sell, license, or commercially exploit our content or designs without written permission.

21. Product Reviews and Submitted Content

If you submit a review, photograph, testimonial, comment, or other content, you represent that you have the right to submit it and that it is accurate, lawful, and not misleading or infringing.

You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, adapt for formatting, and use the submitted content for operating and promoting our business, subject to applicable privacy law. You may request that we stop future promotional use of content that identifies you, although prior lawful uses may not be reversible.

22. Third-Party Services and Links

The website may use or link to third-party services. We do not control and are not responsible for third-party content, terms, availability, security, or privacy practices. Use of a third-party service is subject to its terms.

23. Spiritual, Symbolic, and Wellness Descriptions

Descriptions of gemstones, symbols, Reiki, energy, chakras, intentions, spiritual traditions, or similar concepts are offered for cultural, artistic, inspirational, or informational purposes. They are not medical advice and are not intended to diagnose, treat, cure, or prevent disease. Jewelry is not a substitute for professional medical or mental-health care.

25. Privacy

Our collection and use of personal information are described in our Privacy Policy.

26. Disclaimer of Warranties

Except for express warranties stated in writing and rights that cannot legally be excluded, the website and services are provided on an “as is” and “as available” basis. We disclaim implied warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the website will always be uninterrupted, error-free, secure, or free from harmful components.

27. Limitation of Liability

To the maximum extent permitted by law, Lisa Scala Jewelry and its owner, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, or loss of opportunity arising from use of the website or products.

To the maximum extent permitted by law, our aggregate liability relating to a product or transaction will not exceed the amount paid for the product giving rise to the claim.

These limitations do not apply where prohibited or to liability that cannot legally be limited.

28. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Lisa Scala Jewelry from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the website, violation of these Terms, infringement of another person’s rights, or misuse of a product.

29. Force Majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including natural disaster, severe weather, fire, flood, epidemic, war, terrorism, civil unrest, government action, labor dispute, carrier interruption, supply shortage, power failure, or internet outage.

30. Dispute Resolution and Informal Resolution

Before filing a formal claim, you and Lisa Scala Jewelry agree to make a good-faith effort to resolve the dispute by written notice describing the issue and requested resolution. Send notice to the contact information below and allow at least 30 days for a response.

This section does not prevent either party from seeking relief in small-claims court or requesting urgent injunctive relief where legally available.

31. Governing Law and Venue

These Terms and transactions with Lisa Scala Jewelry are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where another jurisdiction’s mandatory consumer laws apply.

Subject to applicable consumer rights and any valid small-claims option, disputes shall be brought in a state or federal court with jurisdiction in Essex County, Massachusetts.

32. No Waiver

Failure to enforce a provision is not a waiver of the right to enforce it later.

33. Severability

If a provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect.

34. Assignment

You may not assign rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, sale, financing, reorganization, or transfer of the business.

35. Entire Agreement

These Terms and the policies incorporated by reference constitute the entire agreement concerning the website and covered transactions, except for a separate written agreement signed by Lisa Scala Jewelry.

36. Changes to These Terms

We may update these Terms. The version in effect when an order is placed generally governs that order, while continued website use after an update is governed by the updated Terms. Material changes may be highlighted on the website.
